As per the newspaper report, the traffic stop on which the incident took place occurred on the same road while Grimm was capturing the lighting storm into his camera.

A newspaper photographer from OH was shot Monday night by a sheriff's deputy who apparently mistook his camera and tripod for a gun and fired without a warning, the newspaper reported.

The incident took place in the town of New Carlisle, as Andy Grimm, a photojournalist from a local newspaper, unloaded his tripod from his vehicle to take photos of a traffic stop.

Without warning, the deputy opened fire as Grimm was setting up the tripod.

Asked if he thinks the sheriff's deputy or the department should be held accountable for the shooting, Dale Grimm said he'd rather not say anything. "Mat in my vehicle and I heard three shots ring out".

Grimm told Fox 45 that if only he had "said something" to the deputy beforehand, he may have not been shot.

Grimm, who was released from a hospital Tuesday, is asking for sympathy for Shaw.

The Clark County Sheriff's Office has not returned a call seeking comment.

Grimm's father, Dale Grimm, owns the newspaper that serves the community of just over 5,000 people.

Ohio BCI is now in charge of the investigation and any statement will be coming from state Attorney General Mike DeWine's office, Clark County sheriff's officials said.
