In other words it remains to be seen whether Stokes will be charged or not by the CPS.

The New Zealand-born all-rounder has been suspended from playing for England while police investigate his role in the September 25 incident in Bristol, which followed a limited-overs global against the West Indies.

Hales may continue to pay some price though, with Bayliss indicating incumbents Jason Roy and Jonny Bairstow will likely open when the series starts in Melbourne.

Bairstow, Joe Root, Moeen Ali, Chris Woakes and Jake Ball are the only members of England's test squad who will stay on for the ODI series. "We've got to take a decision now and I just think the best way to go is with the two guys who have taken over".
