A federal judge in California has ruled that Facebook can be sued in a class-action lawsuit brought by users in IL who say the social network improperly used facial recognition technology on their uploaded photographs.

Judge Donato didn't agree with Facebook's argument that the law doesn't apply to it, because its servers aren't located in the state.

For privacy reasons the "tag suggestions" features in not available in most countries, and users in the USA can turn it off in the social network's settings.

District judge James Donato has given the go-ahead for a major lawsuit to settle a dispute between the social network and a group of users in IL over the handling of their private data, The Independent reports. If the suit is successful, every person in the class-action could receive a payout. This works by matching faces it spots in photographs with stored "face templates" which are created when a user is tagged in a photograph. Given that, should it lose the case, Facebook could face a fine of between $1,000 (£700) and $5,000 each time a person's image is used without their consent, under the Illinois Biometric Information Privacy Act of 2008, it's clear that this could be a very costly day in court for Facebook.
