Selfe said the DA had invoked a section of the DA's constitution that states that: "A member ceases to be a member when he or she ... publicly declares his or her intention to resign ... from the party".

The Democratic Alliance (DA) on Tuesday morning withdrew party membership of Patricia de Lille - meaning she has lost her seat as a councillor and can no longer hold the position of Mayor of Cape Town, with immediate effect.

But De Lille told EWN that she had rejected the offer.

De Lille will be represented by Dali Mpofu, SC, in the latest application she has filed to oppose the DA's efforts, initially to sanction, and now to remove her.

The matter before the courts therefore was to determine if De Lille was entitled to urgent relief, given the balance of conveniences.

De Lille and her former political party's deputy federal council Chairwoman Natasha Mazzone were both in court for the urgent application. "I must just have a response from my lawyers, then I'll respond", she reportedly said.

De Waal also went into whether the DA correctly interpreted Ms De Lille's words when she said she would "walk away" after clearing her name during a radio interview with Radio 702 on April 26.

She will continue not being a member of the DA and will not be the Mayor of Cape Town until judgment is delivered and only if it will be in her favour.
