California Governor Signs Net Neutrality Bill, FCC Calls It ‘Illegal’

Jerry Brown signed the nation's strongest net neutrality rules into law Sunday, but the federal Justice Department quickly sued to block him, arguing he was interfering in federal powers to set national communications standards.

FCC Chairman Ajit Pai blasted it as illegal, "radical", and "anti-consumer" during a speech last month.

The neutrality law is the latest example of California, ground zero of the global technology industry, attempting to drive public policy outside its borders and rebuff President Donald Trump's agenda. Thirty other states are debating net neutrality measures of their own. The Justice Department also said the new bill goes against the federal government's "de-regulatory approach to the internet".

State Sen. Hannah-Beth Jackson, the Santa Barbara Democrat who authored the bill, says having more women on boards will make companies more successful because they are better at teamwork and multitasking compared to their male counterparts.

Jerry Brown signed the law.

It prohibits internet providers from blocking or slowing data based on content or from favoring websites or video streams from companies that pay extra.

USTelecom, which represents companies in the broadband sector, said it supports net neutrality but disagreed with the California law.

"Courts have consistently held that when the federal government lacks authority to regulate, it can not preempt states from regulating", said Andrew Schwartzman, a lecturer in public interest law at Georgetown University. "When all is said and done, Comcast, Verizon, and AT&T are going to wish they'd never picked a fight with Internet over net neutrality".

"An agency that has no power to regulate has no power to preempt the states", she said.

"As the Trump Administration continues to unravel numerous critical health care protections and services for women, legislation such as this is urgently needed to make sure that Californians are able to access the full range of reproductive care regardless of where they may live", Leyva said in a statement.

The law was passed in response to the Republican-led FCC's move in December to repeal most of their net neutrality rules, on the rationale that the regulations were stifling investment. "We are confident that we will prevail in this case -because the facts are on our side".

As Gizmodo reports, the bill-now the most far-reaching of its kind and considered the "gold standard" for state-level protections-"prohibits ISPs from intentionally congesting or degrading web traffic for the objective of imposing unreasonable fees on companies that connect users on ISP networks to other parts of the web, also known as interconnection".
