Baby Powder From Decades Ago Caused Cancer, California Jury Finds

J&J also lost appeal on a case in Missouri where the court ordered more than $4 billion to 22 women who blamed their ovarian cancer to asbestos contained in the company's products. In December past year, the company reiterated the safety of its products as a slew of drug regulators around the world such as the US FDA and India's Central Drugs Standard Control Organization (CDSCO) analysed samples of J&J products.

The company is now fighting two asbestos-related lawsuits in New Jersey and Oklahoma courts, and two more trials could begin this month, the UBS analysts said.

Asbestos is found insulation, roofing and some plastics, but according to the American Cancer Society (ACS), the naturally occurring minerals also turn up in the pure form of talc, which is the basis for talcum powder like that used in Johnson & Johnson's products.

"We are disappointed with today's verdict and will pursue an appeal because Johnson's Baby Powder does not contain asbestos or cause cancer", Kim Montagnino, a J&J spokesperson, told Bloomberg.

Mother-of-two Teresa "Terry" Leavitt was diagnosed with mesothelioma in 2017, and her doctors say she is not expected to live past 2020.

Talc and asbestos are often mined together from metamorphic rocks, particularly in North Carolina, Alabama, Vermont and northern Italy. This track record shows that there are one set of facts in these cases, and that decades of tests by independent, non-litigation driven experts and institutions repeatedly confirm that Johnson's Baby Powder does not contain asbestos or cause cancer. They awarded her and her husband damages of $29.4m, but declined to award punitive damages.

"Hundreds of internal J&J documents showed the truth that it has been hiding for years".

"Yet another jury has rejected J&J's misleading claims that its talc was free of asbestos", said Moshe Maimon, a lawyer for Leavitt, in a statement on Wednesday.

Mesothelioma is a awful form of cancer (as if any form of cancer isn't terrible) and Johnson & Johnson will have to do a much better job of convincing juries that their products don't cause cancer.

In response to the lawsuit, Johnson & Johnson released a statement about the verdict, saying the company plans to appeal. Johnson & Johnson won three other cases and another five ended in hung juries.
