About two weeks before charges were dropped against Jussie Smollett, Cook County State's Attorney Kim Foxx texted her staff dismissing Smollett as a "washed up celeb who lied to cops" who was being charged too harshly.

The message was sent to her top assistant Joseph Magats on March 8, shortly after news broke that the "Empire" actor was indicted on 16 felony counts.

The text could prove that Foxx had a heavy hand in deciding that Smollett's charges were excessive enough to drop altogether. Assistant State's Attorney Risa Lanier, the lead prosecutor on the high-profile case, texted Magats hours after the charges were dropped.

Numerous text messages and emails released detail how the State's Attorneys office responded to the furor after the charges were dropped and defended their decision by releasing data on other cases.

"(A pedophile) with 4 victims 10 counts. "Washed up celeb who lied to cops, 16 (counts)", she wrote.

Foxx added: "On a case eligible for deferred prosecution I think it's indicative of something we should be looking at generally". "Just because we can charge something doesn't mean we should". He claimed two men beat and shouted slurs at him and wrapped a noose around his neck. He had been charged with 16 felony counts of disorderly conduct for lying to police about being the victim of a hate crime.

In other communications obtained by CNN through an open records request, Foxx suggested the charges against Smollett were over exaggerated. "16 counts on a class 4 [felony] becomes exhibit A", in messages obtained by The Chicago Tribune published Tuesday.

The messages, released Tuesday, show that after Foxx announced her recusal from the case on February 19 because she said she had been in contact with a relative of Smollett, Foxx continued to internally discuss the case with her top aides, according to WBBM-TV. The Chicago Police Department charge that Smollett staged a hate crime against himself in downtown Chicago in an attempt to boost his career.

She continued, arguing the charges were excessive and making a comparison to the office's pending indictments against R. Kelly.

The texts were included in thousands of pages of texts and emails related to the Smollett case released by the State's Attorney's Office late Tuesday. "I will continue to uphold these guiding principle". Apparently he's coming in to represent the Nigerian brothers in Smollet.

Emanuel said dropping the charges against Smollett "is without a doubt a whitewash of justice".

However, Magats made it clear, "I do not believe he is innocent". She said Johnson seemed "satisfied" with her explanation that Smollett had completed community service and turned over his $10,000 bond money to the city.
