Mnuchin: Never Discussed Trump's Tax Returns With White House

As the White House continues to stonewall efforts by congressional Democrats to obtain President Donald Trump's tax returns, a confidential IRS draft memo that leaked late Tuesday appeared to completely undercut Treasury Secretary Steve Mnuchin's justification for withholding the documents. But he said he did not believe it contradicted his reasoning for denying a request from the House of Representatives Ways and Means Committee for six years of Trump's tax returns.

Mnuchin told US lawmakers he did not know who in the Internal Revenue Service had written the draft memo, which concluded that tax returns must be given to lawmakers unless the president takes the rare step of asserting executive privilege.

"The memo was marked 'draft, ' it was not a final memo", Mnuchin said at the committee hearing.

Treasury Secretary Steven Mnuchin says he has not reviewed an IRS memo that says the president must turnover his tax returns to Congress. IRS Commissioner Charles Rettig testified last month that there is no rule prohibiting Trump from releasing his tax returns.

The internal draft memo argues otherwise, but Mnuchin says he didn't know about it, learning about the letter only on Monday.

Mnuchin has repeatedly refused to deliver the tax returns to Congress leading up to the subpoena pressure, arguing in his denial after consulting Department of Justice lawyers that the "unprecedented" request raised "serious constitutional questions".

The 10-page memo says the law "does not allow the secretary to exercise discretion in disclosing the information provided the statutory conditions are met". Lacking a legislative objective would be insufficient.

The "only basis the agency's refusal to comply with a committee's subpoena would be the invocation of the doctrine of executive privilege", the memo states, per the paper.

"If I had turned them over, I would have been violating the law", Mnuchin told the House Financial Services Committee on Wednesday.

Trump declined to reveal his tax returns during the 2016 presidential election, claiming he was under audit.

'We're trying to find out who wrote the memo, where it came from, when it was and why it wasn't distributed, ' he added.

Mnuchin told a Senate panel last week that Treasury officials would be willing to help members of the Ways and Means Committee examine the process without seeing the President's returns - an offer the secretary said the committee hasn't accepted yet. He maintains that the committee is looking into the effectiveness of IRS mandatory audits of tax returns of all sitting presidents, a way to justify his claim that the panel has a potential legislative goal. The reason why he does not want us to see his tax returns is likely because he wants to keep his business network hidden-perhaps due to the fact that one of his businesses was hit with what was at the time, the largest anti-money laundering fine ever given out to a casino, and Trump Taj Mahal admitted to "long standing anti-money laundering violations".
